You contradict yourself.
There is no evidence that a crime occured. The defendent is, by definition, innocent of a crime which did not occur.

Justice depends to a great extent on risk. Where there is a significant chance of being wrong, it is decidedly unjust to invoke an irreversible penalty.

From my perspective, justice is a fitting approach to a crime. It may involve rehabilitation. it may involve restitution, where possible. It may involve removing the criminal from society in one way or another.
Justice is, simply put, doing what's "right" - for the victims, for society as a whole and yes, for the offender too. To suggest that you can do what's right without regard to the possibility/probability of making mistakes is, frankly, ludicrous.
