A significant blow to qualified immunity?
Today the Supreme Court ruled that courts must take into account the “totality of circumstances” leading up to a police incident, not just the “moment of threat.” Hopefully this is just the first chip in the armor of qualified immunity that, in effect, allows police to kill with impunity in nearly every instance. The exceptions are few and far between.
