If you take your servant's eye, you give him the other one - i.e. you give him his freedom - as compensation. You don't take the malefactor's eye, you give one to the victim. Your own quote agrees with that.

It's the Biblical way.

As Jesus pointed out, punishment in the form of taking an eye for an eye is NOT one of the Biblical ways.

Our justice systems don't make the punishment fit the crime. They make the punishment (if any) fit the criminal. Repeat offenders get harsher treatment, underage offenders get more lenient treatment, etc.
