They decide standing issues but not based on their whims. Standing is, at least in part, a constitutional issue. And where the first amendment is concerned, courts and even the legislature are not free to just make up their own rules. Such folks will lose immediately. That's not a problem even if we don't put in the kind of laws RAZD suggests. You are not making your case with this argument, because your outcome will be a bad one.

But in reality the courts do make up their own rules even today which is why cases are appealed and move up a chain to the court that can and does make up their own rules. And the buffoons are very likely gonna succeed in packing that court and several layers under that court as things go for at least a few decades. Only if the courts and judges are reality based decision makers. It has not been very long since many courts would never take the word of a non-white over a white man; regardless of any evidence that existed.

In reality, the courts interpret the rules. It is a subtle yet important distinction. The principle that we have always pushed towards is an unbiased and independent judiciary. I don't think we will ever attain a perfect judiciary, but it has certainly improved over the years. Let's just hope we don't take a step backwards.
